Welcome to Musical Bead! This User Agreement (“Agreement”) is a legal agreement between you (“User”) and Musical Bead governing your use of the Musical Bead mobile application (“App”). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, please do not use the App.

1. Description of the App

Musical Bead is a mobile application that allows you to save photos, videos, and voice recordings to your smart NFC card and virtual account. The App is available for free download, providing Users with a free data storage capacity of up to 1 GB.

2. Subscription Model

For Users who require more than 1 GB of data storage, we offer a subscription model. The subscription options are as follows:

• Musical Bead Basic: Free, with 1 GB of storage.
• Musical Bead Plus: $4 per month, offering 250 GB of storage.
• Musical Bead Pro: $9.99 per month, offering 1 TB of storage.

Payments will be charged to your preferred payment method associated with your app store account at the time of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. No refunds will be provided for unused portions.

3. User Conduct

You agree to use the App in compliance with all applicable laws and not misuse the App, including:

• Uploading harmful or illegal content.
• Attempting to disrupt the App’s operation.
• Violating any third-party rights.

4. Privacy

Your use of the App is governed by our Privacy Policy, which can be found at: https://musicalbead.com/privacy-policy. By using the App, you consent to the collection and use of your information as outlined in the Privacy Policy.

5. Modification to the Agreement

We reserve the right to modify this Agreement at any time. Changes will be posted within the App or by other reasonable means. Continued use of the App after changes constitutes your acceptance of the new Agreement.

6. Termination

We may terminate or suspend your access to the App at any time, with or without cause, effective immediately.

7. Disclaimer of Warranties

The App is provided “as is” and “as available,” without any warranties of any kind, either express or implied.

8. Limitation of Liability

To the maximum extent permitted by law, Musical Bead is not liable for any indirect, incidental, special, consequential, or punitive damages, including any loss of profits, revenues, or data, resulting from your use of the App.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of California, without regard to its conflict of law principles.
